General Terms and Conditions for Guest Cards
Applies to the various guest cards in the region
Please read these provisions carefully before using the card.
1. General
1.1 Definition of terms / position of the parties involved:
- The "Guest Card" is an offer of Alpenregion Bludenz Tourismus GmbH (hereinafter TVB) and selected service partners in the Bludenz Alpine Region.
- The "card service" is the combination of various services of several service partners into one product, namely the "Brandnertal, Bludenz, Klostertal Guest Card" and the "Walser Guest Card", hereinafter referred to as the "Guest Card". The card service may consist of a discount, special offer, free travel or free admission.
- "Alpenregion Bludenz Tourismus GmbH" is the issuer and administrator of the Guest Card, unless expressly stated otherwise.
- The "service partners" are those companies (e.g. mountain railroads, public transport, operators of leisure or cultural facilities such as museums, swimming pools, climbing gyms, etc.) that provide the respective service to the legitimate cardholder (guest) on the basis of their general terms and conditions and conditions of carriage. An overview of the service partners can be found on the website.
- The "accommodation provider" is an accommodation establishment in the Bludenz Alpine Region and is exclusively responsible for issuing and issuing the guest card to the guest.
1.2 Contractual basis:
The service partners are companies which, in whatever legal form, provide their respective card service on their own responsibility and legally independently. Upon receipt of the guest card, a framework contract is concluded between the guest and the TVB.
However, the specific individual or service contract is only concluded with the guest and the service partner whose specific card service the guest uses when using the guest card.
The contractual basis for the provision of the card service of the guest card are therefore exclusively the terms and conditions and conditions of carriage of the respective service partner.
1.3 Only the respective service partner is obliged to provide the respective card service in accordance with the service contract concluded within the scope of use. Neither Alpenregion Bludenz Tourismus GmbH nor the accommodation providers are contractual partners with regard to the card service to be provided, nor are they intermediaries or agents of the corresponding service contract. Furthermore, they do not have the status of a tour operator.
1.4 The following terms and conditions (GTC) regulate the use of the guest card (framework agreement) in addition to the general terms and conditions and conditions of carriage of the service partners.
2. Scope of services guest card
2.1 The guest card is available to the guest free of charge and is issued by the TVB and issued by the accommodation provider in accordance with section 3 of these terms and conditions. The prerequisite for receiving the guest card is one (1) overnight stay by the guest with an accommodation provider in the Bludenz Alpine Region.
2.2 Every guest is entitled to make use of the card service in accordance with the General Terms and Conditions and Conditions of Carriage of the respective service partner, the statutory provisions and the general availability of the service. An overview of the card service can be found in the guest card brochure and on the website.
2.3 The card service of the guest card cannot be combined with other promotions and discounts of the service partners. However, the guest is free to take advantage of the more favorable promotion. The offers of the service partners are generally non-binding and are only valid while stocks last. The guest has no general legal entitlement to free or discounted use of the card service.
3. Entitlement to and purchase of the guest card
3.1 The guest card is not available for over-the-counter purchase. Only guests who are staying with an accommodation provider for at least one (1) night in the Bludenz Alpine Region and who have been registered in accordance with the legal requirements are entitled to the guest card.
3.2 The guest card is issued and issued to the guest by the accommodation provider - except in the event of loss or theft in accordance with section 6.3. For this purpose, the guest must provide the following personal data: First name, surname, date of birth, date of arrival and departure.
4. Validity
4.1 The guest card is only valid once it has been completed and registered by the accommodation provider and in conjunction with a photo ID. The guest card is non-transferable and may only be used by the person to whom the card is issued.
4.2 The use of the card service of the guest card is valid in the summer season from 01.05. - 31.10. and in the winter season from 01.11. - 30.04. (hereinafter: promotion period). The guest card is valid from the day of arrival to the day of departure (hereinafter: period of stay) of the guest. After departure, the guest card automatically loses its validity and does not have to be canceled by the guest.
4.3 Depending on the card service, it can be used several times within the period of stay. However, there is no fundamental entitlement to multiple use of a card service.
5. Use of the card service
5.1 The guest acknowledges that the operating and opening hours of certain service partners may not coincide with the entire promotional period due to seasonal factors and therefore not all card services may be available.
5.2 The prerequisite for the use of a card service is the unsolicited presentation of the guest card. A guest card must be presented for both participating children and participating adults when using the service. At the request of the service partner, the guest must also present a valid photo ID. If the guest is unable or unwilling to comply with this request, the service partner may refuse to provide the card service.
5.3 The guest is obliged to familiarize themselves with the respective conditions of use, transport and other conditions and, if applicable, safety precautions of the service partner before using the card service and to follow the instructions of the service partner.
5.4 The service partner may refuse to provide the card service and to conclude service contracts with the guest in individual cases if objective reasons prevent the conclusion of the contract or the provision of the service.
Reasons for refusal include, in particular:
- Natural disasters and other cases of force majeure
- Changed weather conditions
- Maintenance work and repairs
- Endangerment of the guest's own safety or endangerment of third parties
- Poor health of the guest, inadequate equipment of the guest, inappropriate clothing of the guest
- breach by the guest of regulations (general terms and conditions, conditions of carriage, other requirements) of the service partner
- Refusal to present a photo ID or similar reasons
- Overcrowding/overutilization of the facilities
- insufficient participation or exceeding the maximum number of participants/utilization of the service partner's facilities
- other reasons in the overriding legitimate interest of the service partner
In these cases, the guest has no claims for performance or compensation against the service partner.
5.5 The guest card does not include any insurance benefits.
6. Passing on, loss and defect of the guest card
6.1 Passing on the guest card is not permitted. If the guest card is passed on, the guest is also liable for any misuse of the guest card by third parties.
6.2 In the event of misuse or suspected misuse, the service partner is entitled and obliged to retain the guest card without compensation and, if necessary, to block it. In the event of demonstrable misuse or reasonable suspicion of misuse, a complaint will be made.
6.3 Theft or loss of the guest card must be reported immediately to the accommodation provider or TVB. The accommodation provider or TVB can then issue a new guest card. The lost guest card will be blocked when a new card is issued and thus loses its validity.
6.4 Defective guest cards will be replaced by the accommodation provider.
6.5 In the event of early departure, the guest card will be blocked for the remaining period of validity.
7. Warranty and liability
7.1 TVB expressly does not guarantee that the card service of the guest card can actually be used at the service partner.
7.2 TVB only guarantees that the card service of the guest card can be used in accordance with these GTC during the operating hours.
7.3 TVB is liable to the guest under the framework agreement without limitation only in the event of intent and gross negligence and for personal injury. Liability for slight negligence, compensation for consequential damage and financial loss, immaterial damage, unrealized savings, loss of profit and damage from third-party claims against TVB is excluded.
7.4 The liability of the service partner under the service contract concluded with the guest is determined in accordance with the statutory provisions (in particular the EKHG and SeilbahnG) as well as its General Terms and Conditions and Conditions of Carriage. Any liability, whether based on statutory or contractual provisions, for incidents arising from the use of a ticket service (e.g. transportation service of a mountain railway operator) shall be the sole responsibility of the service partner in whose sphere the incident occurred. The other service partners or TVB or the accommodation provider are not liable.
8. Data protection
The accommodation provider or TVB collects, processes and uses the guest's personal data only insofar as this is necessary for the fulfillment of the contract. The guest's data is therefore only collected and processed for the provision of the card service. Further information on data protection can be found in our privacy policy.
9. Other matters
9. 1 There are no verbal collateral agreements to these GTC. Collateral agreements of any kind whatsoever as well as amendments or supplements must be made in writing to be effective. This also applies to any waiver of this written form requirement.
9.2 For any disputes arising from the use and issue of the Premium Guest Card, the exclusive applicability of Austrian law is agreed, excluding the UN Convention on Contracts for the International Sale of Goods and the Austrian conflict of law rules.
9.3 Notwithstanding mandatory statutory provisions, the place of jurisdiction for all legal disputes between TVB and the guest shall be the court with subject-matter jurisdiction for TVB. TVB is free to choose the competent court at the Guest's place of residence as the place of jurisdiction.
9.4 If one or more of the provisions of these GTC is/are invalid, TVB and the Guest shall expressly agree on such legally valid provisions that come closest to the economic purpose of the invalid provision. The validity of the remaining provisions shall not be affected by a void provision.
